Acceptance of Terms
By accessing or using www.soflylifestyle.org (the "Platform"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must immediately discontinue use.
These Terms constitute a binding legal agreement between you ("User," "Client," or "Member") and SoFly Lifestyle LLC ("Company," "SoFly," "we," "us," or "our").

Nature of Services – Marketplace Disclosure
SoFly Lifestyle is a luxury concierge and brokerage platform that connects clients with independent third-party providers offering services such as:
- Private aviation
- Yacht charters
- Exotic vehicle rentals
- Villa & mansion rentals
- Chauffeur services
- Security personnel
- Event access
- Travel services
SoFly Lifestyle does NOT own, operate, manage, control, or supervise aircraft, vessels, vehicles, properties, security personnel, or transportation services. All services are performed exclusively by independent third-party operators. SoFly acts solely as an intermediary and facilitator.

No Operator Status
You expressly acknowledge and agree that:
- SoFly is not an air carrier
- SoFly is not a maritime carrier
- SoFly is not a transportation carrier
- SoFly is not a vehicle rental company
- SoFly is not a security contractor
- SoFly is not a travel agency unless otherwise licensed
All transportation and charter services are provided by properly licensed third-party operators.

Insurance Responsibility
All service providers are solely responsible for maintaining required insurance coverage, including but not limited to:
- Aviation liability insurance
- Maritime liability insurance
- Commercial auto insurance
- General liability insurance
- Workers' compensation insurance
SoFly Lifestyle does not provide insurance coverage for Users, passengers, guests, or third parties.
Users are strongly advised to obtain travel insurance, charter insurance, personal liability insurance, and event insurance. Proof of insurance may be required prior to booking certain services.

Waivers Required
Prior to participation in certain activities (including but not limited to aviation, yachting, high-performance driving, and private security services), Users may be required to sign:
- Liability waivers
- Assumption of risk agreements
- Indemnification agreements
- Medical release forms
Failure to execute required waivers may result in cancellation without refund.

Assumption of Risk
By booking any service through SoFly, you voluntarily assume all risks associated with luxury travel and high-risk activities, including but not limited to:
- Aircraft incidents
- Maritime accidents
- Vehicle collisions
- Security-related incidents
- Property damage
- Weather-related delays
- Bodily injury or death
You agree that participation is entirely at your own risk.

Accident Liability Disclaimer
SoFly Lifestyle shall not be liable for:
- Accidents
- Mechanical failures
- Pilot error
- Captain error
- Operator negligence
- Passenger injury
- Property damage
- Delays or cancellations
- Regulatory shutdowns
All claims must be directed solely to the third-party operator providing the service.

Passenger Injury Limitations
To the maximum extent permitted by law:
- SoFly shall not be liable for bodily injury
- SoFly shall not be liable for emotional distress
- SoFly shall not be liable for wrongful death
- SoFly shall not be liable for medical expenses
Any liability, if established, shall be limited to the amount paid directly to SoFly in service fees, excluding third-party costs.

FAA / Coast Guard Compliance
Aviation
All aviation operators are required to comply with FAA Part 135 (or applicable aviation regulations), TSA requirements, and federal aviation safety standards.
Maritime
All maritime operators must comply with U.S. Coast Guard regulations, maritime licensing requirements, and safety equipment standards.
SoFly does not independently verify ongoing compliance but may request documentation at its discretion.

Operator Standards
Third-party providers are expected to maintain valid licenses, required certifications, industry-standard safety practices, professional qualifications, and properly maintained equipment.
However, SoFly does not guarantee service quality, safety outcomes, regulatory compliance, or operator performance.

Indemnification
You agree to indemnify, defend, and hold harmless SoFly Lifestyle LLC, its owners, officers, employees, affiliates, and agents from any claims arising out of:
- Your participation in services
- Your guests' participation
- Violation of laws
- Breach of these Terms
- Personal injury claims
- Property damage claims

Force Majeure
SoFly shall not be liable for failure to perform due to:
- Weather or natural disasters
- Government restrictions
- FAA or Coast Guard restrictions
- War or terrorism
- Labor strikes
- Pandemic events

Payment Terms
- Deposits may be non-refundable
- Full payment may be required prior to service
- Cancellation policies are set by third-party operators
- SoFly service fees may be non-refundable

Dispute Resolution
All disputes shall be resolved by binding arbitration in the State of Florida.
You waive jury trial rights, class action participation, and consolidated claims.

Limitation of Liability
To the fullest extent permitted by law, SoFly's total aggregate liability shall not exceed the service fee paid directly to SoFly.
In no event shall SoFly be liable for indirect damages, punitive damages, consequential damages, lost profits, or reputational harm.

Third-Party Relationship
All providers are independent contractors. No partnership, joint venture, employment, or agency relationship exists between SoFly and any operator.

Age Requirements
Users must be 18 years or older. Certain services may require age 21 or 25+ depending on provider rules.

Governing Law
These Terms are governed by the laws of the State of Florida.

Modifications
SoFly reserves the right to modify these Terms at any time. Continued use constitutes acceptance.
